This indenture made and entered into this sixth day of November in the year one thousand eight hundred and forty between Frederick Perkins of the County of Louisa, Executor of Evelina Johnson deceased, Colin Johnson, and Mary A. his wife, Benjamin S. Johnson, Seymour Johnson and Mildred his wife of the County of Albemarle, William F. Johnson of the County of Louisa of the first part, and Eleven Smith of the County of Louisa of the second part; Witnesseth that for and in consideration of the sum of Five hundred, eighty nine dollars and seventy six cents to them, the said Frederick Perkins as executor as aforesaid, Colin Johnson, Benjamin S. Johnson, Seymour Johnson and William F. Johnson in hand paid by the said Eleven Smith before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged, the said Frederick Perkins as executor, Colin Johnson and Mary A. his wife, Benjamin S. Johnson, Seymour Johnson and Mildred his wife and William F. Johnson have bargained and sold, given and granted and by these presents do bargain, sell, give, grant, alien, assign, transfer, convey and confirm unto the said Eleven Smith and his heirs forever a certain tract of land situated in the County of Louisa, being the land of which Roderick Johnson died seized and possessed, and containing one hundred and ninety four acres more or less, one hundred and eighty six acres, a portion thereof is contained in the following lines: beginning at two post oaks corner to Phil Reynolds and Kent, thence along the ridge fifty degrees East eighty eight poles to pine, corner to Kent. thence along the ridge ... to a post oak on the ridge ... corner to Henson, thence seventy degrees west on hundred and two poles to pointers corner to Henson, thence north fifty three degrees east forty two poles to pointers comer to Poindexter in Henson's line, thence North eighty two and a half degrees West one hundred and twenty two poles to Poindexter's Corner on the Creek, thence along the Creek and branch to Poindexter's corner on the . . . tree; thence South twenty two degrees East on hundred and thirty two poles to pointers corner to John Sergeant and Desper, thence South seventy eight degrees East twenty poles to hickory corner to Phil Reynolds and A. Desper; thence South thirty one degrees East thirty two poles to elbow, thence South twenty five degrees East eight four poles to beginning-and eight acres the balance thereof adjoining the said one hundred and eighty six acres on the southeast side and known as Kent's Tract together with all and singular the appurtenances thereunto belonging to Have and to hold the said tract of land, containing one hundred and ninety four acres more or less, with its appurtenances to him the said Eleven Smith, his heirs and assigns, to his, and their only use and behoof forever. And the said Frederick Perkins as executor aforesaid for himself and his heirs, covenants, and agrees to and with the said Eleven Smith and his heirs that he will warrant and defend and maintain the right, title, and estate of the said Eleven Smith his heirs and assigns in and to that portion of the aforesaid tract of land of which his, the said Frederick Perkins' testatrix died seised and possessed with its appurtenances free from the claims of all persons claiming in. by or through him. And the said Colin Johnson and Mary A. his wife, Benjamin S . Johnson, Seymour Johnson and Mildred his wife, and William F. Johnson for themselves and their heirs covenant and agree to and with the said Eleven Smith his heirs and assigns, that they will forever warrant, defend, and maintain the right, title, and estate of the said Eleven Smith his heirs and assigns in and to the ballance of the aforesaid tract of land, being that part devised to the said Colin Johnson, Benjamin S. Johnson, Seymour Johnson, and William F. Johnson by the last will and testament of Roderick Johnson deceased, with its appurtenances free from the claims of all persons whatsoever. In witness whereof the parties have hereunto set their hands and affixed their seals the day and year first above written.

Albamarle County, to wit:

We John Watson & Thomas Macon justices of the peace in the County aforesaid in the State of Virginia do hereby certify that Mary A. Johnson and Mildred Johnson, the wives of Colin Johnson and Seymour Johnson parties to a certain deed bearing date on the 6th day of November and hereunto annexed personally appeared before us in our County aforesaid and being examined by us [?] and apart from their husbands and having the deed fully explained to them they the said Mary A. Johnson and Mildred Johnson acknowleged the same to be their act and deed, and declared that they had willingly signed sealed and delivered the same and that they wished not to retract it. Given under our hands and seal, this 6th day of November, 1840.

We John Watson and Thomas Macon justices of the peace in the County aforesaid in the State of Virginia do hereby certify that Colin Johnson, Seymour Johnson, Benjamin Johnson, and William F. Johnson, parties to a certain deed bearing date on the 6th day of November and hereto annexed personally appeared before us in our County aforesaid, and acknowldeged the same to be their act and deed, and desired us to certify the said acknowlegement to the Clerk of the County Court of Louisa in order that the said deed may be recorded. Given under order hands and seals this 6th day of Nov. 1840.
